TERMS OF THE ONLINE PAYMENT SERVICE
Please read these terms carefully. These terms are the platform’s terms of use in connection with making payments on the online payment platform or accepting them from the payer. You are therefore asked to accept these terms before making or accepting payments.
These terms have been drawn up in Azerbaijani and English. We ask you to print and keep these terms for future reference. Otherwise, once you have signed them, you may not be able to find them on our website later.
These terms (hereinafter the “Terms”) are concluded between you (hereinafter referred to as “you”, “You”, “user”, “User” or “Customer”) and Us — hereinafter referred to as (“we”, “the platform”, “kinobox.az”).
1Subject matter
1.1. We provide Customers with an online payment facility (unitedpayment.az) for making and accepting payments.
1.2. By using this payment facility, you can make a payment to a designated bank account of our platform.
2Rules for using the payment system
2.1. Within the terms and limitations set out in these Terms, the payment system grants you a limited, non-exclusive, non-transferable and revocable permission to use the system.
2.2. To use the payment system you must register on the platform and make the payment by entering your card account number and password.
2.3. You must provide accurate and complete information and update your account information as necessary so that it remains accurate and complete. The platform does not present your Activity on its own behalf and does not endorse any user content on the Site.
2.4. The Customer is prohibited from:
- a) impersonating another person;
- b) choosing a username that may insult someone or that infringes the rights of any person;
- c) taking any action that infringes the rights of other people or companies, breaks the law, or breaches any contract or legal obligation that may apply to any party;
- d) distributing unsolicited or unauthorised advertising or promotional material, or unwanted mail, spam or chain letters; sending mailing lists, listings, or any automated responses or spam through the Platform;
- e) circumventing any measure applied by the Platform to ensure the security of the Platform and the Services, attempting to gain unauthorised access to any system, data, password or other Platform data, User data or Services, reverse engineering or otherwise disassembling any part of the Services in order to obtain any information, or navigating any part of the Platform without authorisation by using any software;
- g) in breach of the anti-corruption requirements of the applicable legislation, including any information or request in the data about your Activity, or using funds obtained from our Services, for the purpose of financing payments related to an offer, a payment, a promise of payment, the approval of a payment, or the giving of money or any other item of value to an official or employee of a government body, to any person under the control of a state body, to any political party, an official of a political party, or any other person acting in an official capacity;
2.6. If the Customer suspects or discovers unauthorised use of their account, they must notify kinobox.az immediately.
2.7. Kinobox.az is not liable for any loss of data.
2.8. Kinobox.az may remove User content that breaches the Terms at its own discretion. Removing User content or cancelling an account is not a measure that kinobox.az takes without investigation, and investigating and determining the removal of User content or of an account may take some time. The reasons for removing User content, including whether or not to discuss the cancellation of any of your Activity, are solely at the discretion of kinobox.az.
3The Customer’s Activity on the Platform
3.1. After the relevant Application form has been submitted, no term of the Sale may be changed. By way of exception, kinobox.az may permit this after carefully considering the Customer’s request in this regard.
4Payments
4.1. Unless the context requires otherwise, all payments for the price of content are amounts inclusive of VAT.
4.2. Payments must be made by Visa or MasterCard credit or debit card in accordance with the instructions set out in the Application form; other forms of payment may also be offered by the Platform from time to time.
5Warranties
7.1. The Customer warrants to kinobox.az that it holds the legal right and authority in respect of the Intellectual property that may form part of its Activity.
7.2. The Customer further warrants to kinobox.az that:
- a) it holds the legal right and authority to perform and fulfil its obligations under the Terms;
- b) it will perform its obligations under the Terms with reasonable care and skill; and
- c) if the Seller is a natural person, they (i) are a citizen of the Republic of Azerbaijan or hold a permanent residence permit in that country, (ii) have reached 18 years of age;
- d) the Seller warrants that the account number provided for making Payments is an account related to their entrepreneurial activity, and kinobox.az bears no responsibility for this.
8Definitions
For the purposes of these Terms, the following definitions are used:
“Terms” means the agreement consisting of the terms agreed between the Customer and kinobox.az together with all amendments made to those terms from time to time thereafter;
“Payment” means the payments made by users of this Platform for audio-visual content using the Platform.
